The instant application has been taken up for hearing being 04.11.2024 Court No.33 Item No.01 (sayandeep) Suppl. list mentioned by the learned advocate representing the petitioner who submitted that vide order dated 30.10.2024 inadvertently due to typographical error "Additional Chief Judicial Magistrate, Tamluk, Purba Midnapore" was mentioned in place of learned Chief Judicial Magistrate, Tamluk, Purba Midnapore. The learned advocate appearing for the petitioner submitted that the regular Bench dealing with the CRM matters upon mentioning has asked the matter to be placed before the Bench passing the order dated 30.10.2024. Let the mentioning slip moved before the regular Bench be kept on record.
Accordingly, for the ends of justice a supplementary list has been published and the matter is considered for rectification of the order dated 30.10.2024. The order dated 30.10.2024 passed in CRM (SB) 146 of 2024 is modified to the following extent: "Accordingly, the petitioner, Abhijit Das, shall be released on bail upon furnishing a bond of Rs. 10,000/- (Rupees Ten Thousand), with two sureties of like amount each, one of whom must be local, to
the satisfaction of the learned Chief Judicial Magistrate, Tamluk, Purba Midnapore and further condition that the petitioner shall not leave the jurisdiction of Tamluk Police Station and shall meet the inspector-in-charge of Tamluk Police Station once in a week until further order and shall not intimidate, influence any of the witnesses in this case either personally or through his agents or associates. In default, the bail shall be cancelled without any further reference."
The remaining portion of the order dated 30.10.2024 remain unaltered.
Copy of this order to be communicated immediately to the concerned parties for necessary action.
