Learned counsel appearing on behalf of the petitioner submits that apart from the statement of co-accused there are no incriminating materials available against the present petitioner. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He states that other than the statement of the co-accused, the seizure list witnesses also stated that the petitioner was there in the car, but fled away. Besides this, the petitioner happens to be the owner of the car from which the contraband was recovered.

Considering the above, the other materials available in the case diary and the restriction contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
