Kutubuddin ... for the State-respondent(s) Learned advocate for the petitioner submits that 5.23 kgs of codeine phosphate were recovered from the possession of the petitioner along with the another. Learned advocate also submits that the petitioner is in custody for more than one year and, though, charges have been framed but the evidence is yet to commence.

Learned advocate for the State opposes the prayer for bail and submits that FSL report confirms regarding the factum of seizure and all efforts are being exhausted by the prosecution to take the trial of the case to its logical conclusion.

I have considered the submissions advanced by both the parties and I find that 15 witnesses have been proposed

to be examined by the prosecution, as such, there is no possibility of the trial being concluded in the near future. Having considered overall facts and circumstances of the case, I am inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Karima Bibi shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Special Judge (under NDPS Act), Alipore (ld. Addl. Dist. & Sessions Judge, 4th Court, Alipore).

If on bail, the petitioner shall make herself physically available on each and every date of the trial so fixed by the learned trial court and shall not leave the jurisdiction of the district of South 24 Parganas without prior permission of the learned Special Court.

Accordingly, CRM(NDPS) 1457 of 2025 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
