Learned senior advocate appearing for the petitioner submits that there has been no recovery from the present petitioner and the petitioner has been arrested on the basis of statement of co-accused and is in custody for 1 year 2 months.

Learned senior advocate appearing for the NCB, on the other hand, opposes the prayer for bail and submits that in the statement under Section 67 of the NDPS Act by the coaccused person, petitioner has been reflected to be the recipient of the huge quantity of phensedyl which has been recovered in connection with the instant case. Additionally, it has been submitted on behalf of the NCB that in course of custody of the petitioner, 100 litres of

codeine mixture was recovered for which a separate case has been registered.

However, it has been rebutted by the learned senior advocate appearing for the petitioner that in the said case the co-accused was granted bail by the Hon'ble Apex Court and the petitioner subsequently was granted bail by this Court.

Be that as it may, there are no other materials appearing against the present petitioner. Having considered the period of detention and no seizure having been made, I am of the view that further detention of the present petitioner in connection with the instant case is unwarranted. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner viz., Goutam Mondal @ Boss @ Boss Goutam shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Special Court under the NDPS Act-cum-Additional Sessions Judge, 6th Court, Barasat.

If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of North 24-Parganas without prior permission of the learned Special Court.

The application for bail, being CRM (NDPS) 1465 of 2025, is, thus, disposed of.

Report submitted by the learned advocate appearing for the NCB be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
