Ali ... for the Petitioner(s) Mr. Iqbal Kabir Ms. Dhanasree Bisweas ... for the State-respondent(s) Learned advocate for the petitioner submits that 37 kgs of ganja were recovered from the train, but the petitioner and another person have been falsely implicated in connection with the instant case. Learned advocate also submit that the petitioner is in custody for one year and three months.
It is further contended that till date charge has not been framed.
Learned advocate for the State, on the other hand, submits that charges have already been framed and date has already been fixed for evidence.
In view of the stage of the case and the quantity of seizure, I am of the opinion that the rigours of Section 37 of the NDPS Act are attracted.
Having considered the overall facts of the case, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected.
However, the learned trial court is directed to expedite the process of trial so that the case can be taken to its logical conclusion.
Accordingly, CRM(NDPS) 1462 of 2025 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
