The writ petition was preferred as the petitioner was aggrieved by the temporary illegal construction (pandal). To that effect, information was submitted before the jurisdictional court and a civil suit being T.S. No. 106 of 2022 was filed. Since the temporary injunction was allowed by the learned Civil Judge (Junior Division), 1st Court, Barrackpore, I direct that if there is violation of any order passed by the learned Civil Judge, the petitioner would approach the civil court for breach of the said order.

Police authorities would only ensure that there is no violation of law and order.

With the aforesaid observations WPA 26495 of 2024 is disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
