Petitioner approached this court at a stage when the complaint of the petitioner was not entertained and/or registered for investigation. Subsequently, Rajarhat Police Station has registered case. Investigation has commenced, and the investigation has also concluded in a charge sheet wherein the 8 (eight) FIR named accused persons have been charge sheeted.

Presently, the learned CJM, Barasat is in seisin of the case. Petitioner, if she is aggrieved of the investigation, she is entitled to address her grievance under section 173(8) of the Code of Criminal Procedure or section 193(9) of the BNSS.

Petitioner in the affidavit in reply has contended that she and her family members are being still threatened.

In case an application is filed before the learned CJM, Barasat, learned CJM would call for a threat perception report, assess the same and pass necessary directions if required under the Witness Protection Scheme, 2018.

With the aforesaid observations WPA 26502 of 2024 is disposed of.

Report dated 16.12.2024 be kept with the record.
