The petitioner is the retired Headmaster of a School. He was under suspension. The order of suspension was approved by the West Bengal Board of Secondary Education. A criminal proceeding is pending against him before the Criminal Court.

On retirement, the petitioner prays for issuance of provisional pension.

The petitioner approached this Court on an earlier occasion by filing writ petition being W.P.

818 (W) of 2018 which stood disposed of by the Court on 21st November, 2019 referring the entire matter to the Secretary of the West Bengal Board of Secondary Education or its appropriate authority to take a suitable decision in this regard within a stipulated time period.

The said time period has long expired. The Secretary of the West Bengal Board of Secondary Education is yet to take a decision in the matter. 6.

After retirement, the petitioner prays for releasing his provisional pension and other legal dues.

As the matter was already referred to the Secretary of the West Bengal Board of Secondary Education for taking a decision in the matter, accordingly, the Secretary of the West Bengal Board of Secondary Education is directed to consider the matter in terms of the order dated 21st November, 2019 and also take a decision with regard to the present prayer of the petitioner for grant of his retiral dues in accordance with law. 8.

A decision shall be taken in the matter at the earliest but positively within a period of twelve weeks from the date of communication of this order.

The writ petition stands disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
