The petitioner in essence seeks enforcement of an order passed by the learned Civil Judge (Junior Division) 4th Court, Howrah in Title Suit No. 44 of 2006.

It is submitted by the Counsel for the petitioner that by an order dated 25th July, 2019, the said order has been set aside by the learned Additional District Judge, 5th Court, Howrah.

In that view of the matter, the writ petition has become infructuous.

W.P.A. No. 26314 of 2008 shall stand dismissed. Interim order, if any, stands vacated.

A copy of the order dated 25th July, 2019 passed in Misc. Appeal No. 320 of 2006/1190 of 2014 by the learned Additional District Judge, 5th Court, Howrah be kept with the record.

There will be no order as to costs.

All parties are directed to act on a server copy of this order on usual undertakings.
