The petitioner is the unmarried daughter of the deceased Assistant Teacher of a Higher Secondary School, she is praying family pension.

Mr. Suman Dey, learned advocate for the State, on the instruction of the District Inspector of Schools (SE), Nadia, the respondent no. 3 herein, submits that the respondent no. 3 had sent the application of the petitioner for family pension with relevant papers to the Director of Pension, Provident Fund and Group Insurance, Government of West Bengal, the respondent no. 5 herein but the said respondent returned the said papers to the respondent no. 3 again for clarification of some objections. He files the said instruction bearing Memo No. 389/Law/SE/NAD dated December 20, 2022 of the respondent no. 3, let it be kept with the record. The respondent no. 3 is directed to return the pension papers to the respondent no. 5 within this week after necessary clarifications of the objections.

The respondent no. 5, within a period of three weeks from the date of receipt of the said papers, if those are found in order, shall take immediate steps for disbursement of

necessary Pension Payment Order in favour of the petitioner in accordance with law.

WPA 26176 of 2022 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
