Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case on the basis of statement of co-accused and the subject matter of the case relates to recovery of 15 bottles of phensedyl. Petitioner is in custody for a period of 79 days. Learned advocate appearing for the State opposes the prayer for bail. However, State is not in a position to rebut the factum that there has been no seizure from the possession of the present petitioner.
Taking the same into account, I am of the view that further detention of the petitioner in unwarranted. Accordingly, the prayer for bail of the petitioner is allowed.
As such the petitioner namely, Mahadeb Mandal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under NDPS Act cum Additional Sessions Judge, 3rd Court, Malda.
If on bail, the petitioner shall meet with the Investigating Officer of the case once in a week till the chargesheet is submitted before the jurisdictional Court. Accordingly, CRM (NDPS) 1467 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
