The petitioners have approached this Court at a rather belated stage challenging the proceeding initiated by the Bank for sale of the property.

The Bank submits that the sale has already been conducted and the sale certificate has already been issued in respect of the mortgaged property.

The challenge by the petitioners to the steps taken by the Bank has also failed before the Debts Recovery Tribunal sometime in 2024.

Since the sale has already been conducted and third party rights have accrued, the petitioner's right to redemption as stipulated under Section 13(8) SARFAESI Act, has also been exhausted.

6. In view of the aforestated, the writ petition fails and is accordingly dismissed.

There shall be no order as to costs.

8. Since no affidavit has been called for, the allegations contained in the petition are deemed to have been denied.
