(DB) No. 4214 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Amdanga Police Station Case No. 528 of 2021 dated 07.10.2021 under Sections 395/397/412 of the Indian Penal Code and Sections 25/27 of the Arms Act.

And In Re : Sunit Kumar Bhowmik @ Puchu ..... petitioner Mr. Gourab Kumar Nath ... for the petitioner Mr. Neguive Ahmed, learned APP ... for the State Learned Counsel appearing for the petitioner submits he is in custody for over 400 days. It is also submitted that he was not identified during test identification parade. Petitioner prays for bail.

Learned Counsel appearing for the State opposes the prayer for bail and submits stolen cash was recovered from the possession of the petitioner.

We have considered the materials on record. Soon after the incident stolen cash was recovered from the petitioner. In view of the aforesaid incriminating circumstance and gravity of the offence, we are not inclined to grant bail to the petitioner. The application for bail is, thus, rejected.
