Learned advocate appearing for the petitioner submits that beyond the period of limitation Miscellaneous Execution Case No. 105 of 2023 has been preferred under Section 128 of the Code of Criminal Procedure before the learned Judicial Magistrate, 2nd Court Chandannagar, Hooghly.

Perused the order passed by the learned magistrate and I am of the view that there is no scope of interference. Needless to state that the backgrounds of the facts of the case relate to maintenance being prayed by the parents from the son by way of court litigation under Section 125 of the Code of Criminal Procedure wherein there is a specific allegation that after the property was transferred in favour of the present petitioner, hardships were forcefully created upon the parents. The quantum which has been awarded is a meagre of Rs. 1,500/- for each of the parents which amounts to Rs. 3,000/-. Records reflect that no single furthering has been paid. Having regard to the facts of the present case, I am of the view that no interference can be made in the present revisional application.

Accordingly, the present revisional application being CRR 4328 of 2023 is dismissed.
