The grievance of the petitioners is directed against illegal and unauthorized construction on the subject plot being Plot No. 779 situated at Khatian No. 4573, 4572, J.L. No. 28, Mouza Bajitpur, within the jurisdiction of Tarakeswar Police Station, DistrictHooghly. It is submitted on behalf of the petitioners that the private respondents have unlawfully and illegally constructed at the above premises without any lawful authority.

The State is represented and submits that they have no objection if the representation of the petitioners dated July 15, 2024 is disposed of by the Pradhan being the respondent no. 4 in accordance with law.

In view of the above, WPA 26544 of 2024 stands disposed of by directing the respondent no. 4 to consider

and dispose of the representation of the petitioners dated 15th July, 2024 within a period of six weeks from the date of communication of this order.

It is made clear that there is no adjudication on the merits of the case and the respondent no.4 is to act in accordance with law without being influenced by any observation and after hearing all the parties. Affidavit of Service filed by the petitioners is kept with the records.
