Mr. Amitava Ghosh Ms. Nabamita Chatterjee ... for the petitioners. This is an application wherein petitioners have prayed for expeditious disposal of Complaint Case No. 563C of 2010 presently pending before learned Judicial Magistrate, 6th Court, Howrah.

It is submitted on behalf of the petitioners that the accused persons were examined under section 313 Cr.P.C. on 13.08.2024 thereafter arguments was also heard in the month of September, 2024 but till date the judgment has not yet been pronounced by the court below and year after year the court below is mechanically fixing the dates for passing order. Therefore, petitioners prayer is for appropriate direction upon the court below.

Having heard learned counsel for the petitioners, I find that the prayer made by the petitioners is innocuous and if any order is passed in terms of the prayer made by the petitioners, the opposite parties will have no cause to prejudice and as such service of copy of application upon the opposite parties is dispensed with.

From the submission of petitioner it appears that prayer made by the petitioners is justified in view of long pendency of the proceeding and that more than one and a half year have already been passed after examination of accused under section 313 Cr.P.C. and that inspite of hearing argument, the judgment has not been delivered till date.

In such view of the matter, CRR 4952 of 2025 is hereby disposed of with a direction upon the court below to dispose of the aforesaid criminal proceeding within a period of sixty days from the next date of hearing in accordance with law. This order is passed invoking this Court's jurisdiction under section 529 of the BNSS.

Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
