And In the matter of : Abdul Chattar Molla & ors. petitioners Md. Yunush Mondal, Mr. Pronojit Roy ....for the petitioner Mr. Pravas Bhattacharya, Mr. M.F.A. Begg ....for the State CRM(A) 4946 of 2023 is dismissed as infructuous so far as petitioner no.1, namely, Abdul Chattar Molla, petitioner no.2, namely, Meherunnesa Bibi, petitioner no.3, namely, Giyasuddin Gazi @ Dablu and petitioner no.4, namely, Mayannur Gazi are concerned as they surrendered before the jurisdictional Court.

Materials in the Case Diary suggest involvement of the petitioner no.5, namely, Abbas Gazi in the incident of rape. In such circumstances, we are unable to grant anticipatory bail to the petitioner no.5, namely, Abbas Gazi. This application for anticipatory bail in respect of petitioner no.5, namely, Abbas Gazi is, thus, rejected. CRM(A) 4946 of 2023 is disposed of.
