Mr. Rajdeep Bhattacharya Mr. Sandip Ray ..for the petitioner Mr. Manas Kumar Sadhu ..for the State Affidavit of service filed in Court today is taken on record.

In spite of service none appears for the State. Mr. Sadhu, learned advocate, who usually represents the State and is present in Court today, is requested to appear in this matter. Let the appointment of Mr. Sadhu be regularized by the concerned authority.

The learned advocate on record of the petitioner is directed to serve a copy of this writ petition upon Mr. Sadhu in course of this day.

The petitioner claims to be the owner of several plots of land within Mouza Maheshtala under Police Station Maheshtala in the District of 24 Parganas (South). The petitioner alleges that the aforesaid plots were initially the subject matter of an acquisition proceeding but subsequently no further steps was taken and the property of the petitioner has not been utilized for any public purpose. The petitioner submitted a representation dated 8th September, 2025 before the Special Land Acquisition Officer, 24 Parganas (South) being the 3rd

respondent praying for release of the land in question as the same has not been utilized for the intended purpose and the proceeding accordingly stood lapsed.

Mr. Bhattacharya, learned advocate appearing for the petitioner submits that no decision on such representation has been communicated to the petitioner till date.

Without entering into the merits of the claim made in the said representation, the writ petition stands disposed of by directing the Special Land Acquisition Officer, 24 Parganas (South) being the 3rd respondent to consider the representation of the petitioner dated 8th September, 2025 and to dispose of the same by passing a reasoned order after giving an opportunity of hearing to the petitioner or his authorized representative and to communicate the reasoned order to the petitioner immediately thereafter. The entire exercise shall be completed by the 3rd respondent as expeditiously as possible but positively within a period of four weeks from the date of receipt of a server copy of this order along with the copy of the representation dated 8th September, 2025. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
