In Re : An application under Section 482 of the Code of Criminal Procedure, 1973;

In the matter of : Ratan Dey. ...petitioner. The subject matter of challenge in the instant revisional application is the order dated 12.03.2012 passed by the learned Judicial Magistrate, 4th Court, Barrackpore in M. Case No.460 of 2011 under Section 125 of the Code of Criminal Procedure. The said order reflects that the learned Magistrate was pleased to award of Rs.1,000/- per month as interim maintenance to the wife till the disposal of the application under Section 125 of the Code of Criminal Procedure. The next date, i.e., 29.05.2012 was fixed for evidence.

The revisional application is pending since the year 2012 and has not been admitted till date.

Having regard to the time period which has elapsed in the meantime as also quantum of maintenance which was awarded by the learned Magistrate, I am of the view that the same do not call for interference and, as such, is dismissed.

Accordingly, CRR 3507 of 2012 is dismissed.
