Petitioner is aggrieved by the fact that the private 10.04.2025 Court No. 35 Item No.12 Rakib respondents are threatening him and hurling abuses for evicting him from his lawful occupancy.

Learned advocate for the private respondents on the other hand submits that the main accusations are against the State respondents but unnecessarily the private respondents have been embroiled in the accusations so made.

Be that as it may, State has submitted a report. Report reflects that since the allegations are of threat and abuse police authorities have taken steps by drawing up proceedings under Section 126 of the BNSS.

Having considered the nature of the dispute, I am of the opinion that there is no scope for interference by the police authorities except for keeping surveillance in respect of any breach of the peace and/or tranquility taking place, police would additionally see that no

untoward incident results because of the inimical relationship existing between the parties.

With the aforesaid observations, WPA 26547 of 2024 is disposed of.

Report so submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
