(M) 2401 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Rejinagar Police Station Case No. 175 of 2023 dated 08.07.2023 under Section 302 of the Indian Penal Code read with Section 4 of the Explosive Substances Act and charge-sheet submitted under Sections 302/120B of the Indian Penal Code.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years 3 months. It has been submitted that till date, only 3 witnesses have been examined out of 28 witnesses proposed to be examined. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that there are 14 other cases against the present petitioner which includes offences under Section 302 of the I.P.C. and also under Section 307 of the I.P.C. A list has been handed over by the learned advocate for the State. Let the same be kept with the record.

Having regard to the antecedents of the present petitioner, I am not inclined to release the petitioner on bail

at this stage. As such, the prayer for bail of the petitioner is rejected.

State is directed to examine at least ten more witnesses by 15th May, 2026.

No unnecessary adjournment be granted to any of the parties by the learned Trial Court and trial of the case would continue in spite of any resolution of the local Bar. Petitioner will renew his prayer for bail in case there are violations of the conditions after the aforesaid period. Learned advocate for the State would be at liberty to communicate this order to the learned Trial Court. The application for bail, being CRM (M) 2401 of 2025, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
