The petitioner trust is running a Nursing College under the name and style of "Bright Institute of Nursing" at Village Dadpur, District: 24-Parganas (North). The West Bengal Nursing Council ('WBNC' in short) has alleged serious irregularities in the Administration of the said College.

Mr. Abir Sarkar, learned advocate for the WBNC, in course of hearing of the matter, had submitted that to ascertain the present position of the said college and to take remedial measures, the Principal of the said college was directed to meet the authorities of the Council but the said Principal did not turn up. This Court, under such circumstances, had desired personal appearance of the said Principal though no formal order to the said effect was passed.

Today Mr. Karar, learned advocate for the petitioner submits that the Principal has resigned.

This is a ploy to avoid the responsibility. The writ petition being WPA 26171 of 2025 is dismissed with costs of Rs.1,00,000/- (Rupees One Lakh only) to be paid by the petitioner trust, Bright Education Welfare Trust (BEWT) in favour of the West Bengal Nursing Council within a period of two weeks from date.

The WBNC is directed to take immediate action against the said nursing college.
