Learned Counsel for the petitioner submits he is in custody for over one year. He prays for bail. 2.

Learned Counsel for the State opposes the bail prayer.

We have considered the materials on record.

Statements of witnesses and contemporaneous documents i.e. seizure memorandum show 87.6 Kgs. of Ganja was recovered from the possession of the petitioner. Date for examination of prosecution witness has been fixed. Under such circumstances and in light of the statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner either on merits or on the score of delay in trial.
