1. Affidavit-of-service filed in Court today be taken on record.
2. The petitioner has applied for transfer on the medical condition of her son, who is suffering from Cancer. She seeks transfer from Jagatpur High School, Khanakul, in the District of Hooghly to a School nearby her residence at Bankura. The application remains unconsidered.
3. In those circumstances, the District Inspector of Schools (SE), Hooghly shall obtain an independent medical opinion of the C.M.O.H, Hooghly on the medical condition of the petitioner's son and based on such medical opinion shall take an appropriate decision in the matter.
4. If the medical condition of the son of the petitioner is confirmed, the petitioner's application shall be forwarded by the District Inspector of Schools (SE), Hooghly to the Chairman, Central School Service
Commission. The Chairman, Central School Service Commission shall take an appropriate decision in the matter to post the petitioner to any chosen School or one nearby her residence.
5. For the aforesaid purpose, the Chairman, Central School Service Commission may call the petitioner for a personal discussion on the subject and issue appropriate recommendation and transmit the same to the West Bengal Board of Primary Education. The Board shall thereafter issue an appropriate order in accordance with law.
6. The aforesaid process shall be carried out offline and preferably within a period of 45 days from the date of receipt of a copy of this order.
7. With the aforesaid directions, the instant writ petition shall stand disposed of.
8. There will be no order as to costs.
9. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
