Learned advocate appearing for the petitioner is aggrieved by the order dated 14.09.2023 passed by learned Sessions Judge, Birbhum in Criminal Appeal No. 50 of 2019 arising out of Misc. Case No. 04 of 2014. The Misc. case is of the year 2014 and the petitioner being a lady is aggrieved because of the reason that on behalf of the husband and the other in-laws purposely there was no participation before the appeal court. The approach of the opposite party nos. 2 and 3 are intentional to delay and frustrate both the petitioner and also the litigation including the reliefs as prayed for under the relevant legislation. Since the appeal has already been restored by the learned sessions Judge, at this stage interference will delay the proceedings and dilute the purpose for which the petitioner approached this Court.
Learned District and Sessions Judge, Birbhum is directed to dispose of Criminal Appeal No. 50 of 2019 on merits. If any date has been fixed subsequent to 31.01.2024, learned court would prepone the date by issuing notice to both the parties. Dates be fixed in the meantime within the next sixty days at regular intervals so that prior to 25.01.2024, hearing of the appeal is concluded.
court would take efforts to pronounce the judgement on or before 31.01.2024.
With the aforesaid observations, the revisional application being CRR 4339 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
