Samiul Haque ... for the petitioner This is an application filed by the petitioner praying for expeditious disposal of Title Appeal No. 406 of 1993 presently pending before the learned Additional District Judge, 14th Court at Alipore, South 24-Parganas. Petitioner contended that the instant appeal was preferred in the year 1993 i.e. more than thirty years back but still it is pending for disposal and as such a direction may be given upon the Court below for expeditious disposal of the appeal.

Since the prayer made on behalf of the petitioner is innocuous and if an order is passed in terms of the prayer made in the said application, the opposite party will have no cause to prejudice the service of copy of application or notice upon the opposite party is dispensed with.

Having considered that the prayer made on behalf

of the petitioner is justified, C.O. 3836 of 2024 is hereby disposed of with a direction upon the Court below to make every endeavor for expeditious disposal of the appeal and to make best effort to conclude the entire proceeding of the pending Title Appeal No. 406 of 1993 preferably within a period of six months from the date of communication of this order.

With the above observation, C.O. 3836 of 2024 stands disposed of.
