IN THE HIGH COURT AT CALCUTTA

Criminal Revisional Jurisdiction 31-07-2023 Subha Item no.27 Ct no.34 CRR 4343 of 2022 Sri Pintu Mahata -versus- Smt. Swarnalata Mahata & Ors.

Mr. Tarapada Das ..........for the petitioner.

Learned advocate for the petitioner is aggrieved by the order dated 07.12.2021 passed in Misc. Case No. 44 of 2020 by the learned Judicial Magistrate, Khatra. By the said order, the learned Magistrate allowed the ad interim maintenance application granting Rs.3000/- per month to the wife and Rs.1000/- each of the two minor child aggregating to a sum of Rs.5000/- . Record of the revisional application reflects that the present petitioner/husband is an employee of CRPF, although the learned advocate submits that he is an employee of CSIF. Be that as it may, the petitioner would produce the recent salary receipt in course of evidence if he prays for alteration of quantum of maintenance at the final stages of the case. Learned Magistrate would take into account the same and decide the quantum to be awarded to the two minors as well as the wife. No interference is made at this stage.

With the aforesaid observations, the revisional application being CRR 4343 of 2022 is disposed of.

Pending applications, if any, are consequently disposed of.

All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
