The petitioner is a tribal and he holds certain land in his own name. Due to some medical emergency, he requires immediate financial support. He intends to sell off his land. All steps taken by the petitioner to find out a buyer from the tribal community for purchase of the land has turned out to be futile. Newspaper publication has also not helped the petitioner to get a purchaser.

The petitioner made a representation (Annexure P6, p.31) before the concerned respondent authorities seeking permission to permit the petitioner to sell off his land to a non-tribal. Such representation is pending consideration till date. 4.

As the petitioner is in need of immediate financial assistance, the court thinks it fit to dispose of the writ petition with the following directions.

The fourth respondent - the Additional District Magistrate and District Land and Land Reforms

Officer, 24 Parganas (North) - is directed to consider the representation filed by the petitioner permitting him to sell off his land to a non-tribal. Steps shall be taken in the matter in accordance with law at the earliest but positively within a period of eight weeks from the date of communication of this order. A reasoned order shall be passed in this matter and communicated to the petitioner.

Learned counsel for the petitioner shall forward the representation of the petitioner before the concerned authority along with all other supporting documents at the time of communicating the order of this Court.

The writ petition is disposed of.
