Rakib (Allowed) CRM (M) 2404 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Gazole Police Station case no. 53 of 2024 dated 21.01.2024 under Sections 342/354B/354C/386/509/506/34 of the Indian Penal Code and Sections 12/14/15/17/18 of the POCSO Act.

The investigating officer of the case is present and has submitted a report which reflects that report was received from the Cyber Expert and a supplementary charge-sheet submitted before the jurisdictional Court. The evidence of the victim in this case is over and it is reflected that prosecution cited 20 witnesses in the two charge-sheets.

Learned advocate appearing for the petitioners submits that petitioners are in custody for two years two months. Having regard to the period of detention and the possibility of the trial concluding in a short period of time being not possible and without commenting on the merits of the case, I am inclined to release the petitioners on bail.

Accordingly, petitioners namely, Sujit Halder and Bikaram Bala @ Bikram Bala shall be released on bail upon furnishing bond

of Rs. 20,000/- (Rupees Twenty Thousand only) each, with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Additional District and Sessions Judge, 2nd Court, Malda cum learned Special Court under the POCSO Act.

If on bail, the petitioners shall not leave the jurisdiction of District of Malda without the prior permission of the learned trial Court and shall be physically present on each and every date fixed by the learned trial Court.

In case, there are any violations of the aforesaid conditions, the learned trial Court/Special Court would be at liberty to cancel the bail without further reference to this Court. Accordingly, the application for bail being CRM (M) No. 2404 of 2025 is allowed.

The investigating officer of the case is present, his further appearance before this Court is dispensed with. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
