Heard learned Advocates for both the parties. 2.

We have considered the materials on record. Petitioner nos.1, 2 & 4 are in custody for about 173 days and petitioner nos.3 & 5 are in custody for about 167 days. Co-accused similarly circumstanced with the petitioner has been enlarged on bail. Under such circumstances, we are inclined to extend the same privilege to the petitioners. 3.

Therefore, the petitioners, namely (1) Bimal Manna, (2) Dulal Manna, (3) Bapan Bera @ Sandip Bera, (4) Mithun Manna & (5) Sanjib Manna @ Sanjit Manna @ Golden, be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only) each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Haldia, Purba Midnapore subject to condition that the said petitioners shall appear before the trial court on every date of hearing until further orders Signed By : ARUP KUMAR DAS High Court of Calcutta 14 th of November 2024 04:25:11 PM

and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.

In the event they fail to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel their bail automatically without reference to this court. 5.
