Ct.237. Suman Ghosh Bd. -Vs- Tanusree Ghosh Mr. Sandip Dutta ...for the Petitioner. This is an application wherein petitioner has prayed for a direction upon the court below for expeditious disposal of the petition dated 14.06.24 by which the defendant/opposite party herein has challenged the maintainability of the suit.

The main grievance ventilated herein by the petitioner is that the last date was fixed on 21st September, 2024 last year for hearing the said application and thereafter case has been fixed on 28th February, 2025. Accordingly, he prayed for necessary direction for expeditious disposal of the said application as well as the suit.

Since the prayer made on behalf of the petitioner is innocuous and if any order is passed in terms of the prayer made by the petitioner in the application, neither party will have a cause to prejudice, the service of copy of application along with notice upon the opposite party is dispensed with.

Having heard the facts and circumstances of the case and that the prayer made on behalf of the petitioner is justified, C.O. 3839 of 2024 is hereby disposed of with a direction upon the court below to dispose of the application challenging the maintainability of the suit on the next date of hearing i.e., on 28th February, 2025 or within a period of two weeks thereafter.
