Petitioner is aggrieved by the fact that the order of the civil court passed in T.S.115 of 2021 is violated.

Learned advocate for the State has submitted a report. Report reflects that on 24.02.2023 both the parties were directed by the police authorities to maintain status quo and not to violate the injunction order.

Petitioner complains that on 17.02.2023 petitioner informed the court.

Consequently, Inspector-in-Charge, Basirhat Police Station was directed to implement the injunction order.

In view of the subject matter of dispute relating to construction of pucca road is of February,

2023 and the complaint has been made on 8th October, 2024, after more than 1 1⁄2 years after the alleged violation, I direct the petitioner to approach the jurisdictional civil court with prayers relevant in the pending suit. However, in the meantime, police would keep a strict vigil and ensure that the civil court's order is respected and obeyed.

With the aforesaid observations, WPA 26586 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
