It is the case of the petitioner that the electricity connection at the petitioner's premises was disconnected due to natural calamity. After the said disconnection the petitioner lodged a complaint with the respondent authorities. On the basis of the said complaint the officials of the respondent authorities went to the petitioner's premises for the replacement of the service cable on 08.12.2023 but they failed to restore the said electricity connection due to the frivolous objection raised by the respondent nos. 5 and 6.

The petitioner further contended that, in order to redress his grievances, he had approached the SubDivisional Magistrate, Contai by invoking the provisions of Section 144(2) Cr.PC.

Vide an order dated January 25, 2024 the SubDivisional Magistrate, Contai directed the respondent authorities to restore the electricity supply to the petitioner's premises with the assistance of police protection.

However, despite the said order, the respondent authorities failed to comply with the said order and on the contrary submitted a report before the SubDivisional Magistrate, Contai. Being aggrieved by the continued inaction of the respondent authorities, the present writ petition has been preferred by the petitioner.

Learned Counsel for the respondent authorities submits that they are willing to restore the electricity connection if adequate police assistance is provided to them to ensure the safe execution of the work. In view of the same, this Court deems it appropriate to direct the respondent no.4, the Officer-in-Charge, Khejuri Police Station to provide necessary police assistance to the respondent authorities to facilitate the restoration of electricity connection to the petitioner's premises.

The cost for such police protection shall be borne by the petitioner.

With the above direction, the present writ petition is disposed of.
