Learned counsel appearing on behalf of the petitioner submits that two other co-accused were arrested and were granted bail. The petitioner has been falsely implicated in this case. Learned counsel appearing on behalf of the State relies on the injury report, which shows several injuries including a cut injury inflicted on a vital part of the body, namely, the head. She relies on the statement of the victim and the statement of a local post occurrence witness.

The prosecution case is that the petitioner and two others blocked the car of the victim on the road and thereafter assaulted him. Considering the incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
