The writ petitioner complains that his wife/the respondent no. 4 has driven him out of the house. The house stands in the name of the petitioner. On the complaint of the petitioner, FIR No. 135 of 2022 dated 12th October, 2020 has been registered and after proper investigation, Charge Sheet No. 108 of 2020 dated 30.10.2020 has been filed.

Likewise on the complaint of the private respondent, the Police have registered FIR No. 98 of 2020 dated 6th August, 2020. Investigation has been completed and the Charge Sheet No. 86 of 2020 under Sections 498A/506/34 of the IPC has been filed.

The private respondent/wife is represented and submits that she has no objection to the petitioner returning to the house.

The petitioner may return to his house.

Instructions of the Madhabdihi Police Station dated 01.12.2022 is taken on record.

The writ petition is disposed of.

7.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
