Mr. Shibasis Chatterjee ...For the Petitioners This is an application wherein the petitioners have prayed for expeditious disposal of the Misc. Case No. 36 of 2022 arising out of Title Execution Case No. 06 of 2021 presently pending before the learned Civil Judge (Junior Division), 2nd Court at Berhampore, Murshidabad. It is submitted on behalf of the petitioner that the said Misc. Case for seeking police help was filed on 5th July, 2022 and since then it is pending for disposal before the Court below.

The prayer made on behalf of the petitioners is innocuous and if any order is passed in terms of the said prayer, neither party will have any cause to prejudice, service of notice and copy of the application upon the opposite parties are dispensed with.

Since the prayer made herein is justified in terms of long pendency of the application, C.O. 3842 of 2024 is hereby disposed of with a direction upon the Court below for making every endeavour for expeditious disposal of the said Misc. Case No. 36 of 2022 as well as the Title Execution Case No. 06 of 2021, presently pending before the learned

Civil Judge (Junior Division), 2nd Court at Berhampore, Murshidabad and to make his best effort to conclude the entire proceeding of the said Misc case as well as the Title Execution case, preferably within a period of sixty days from the date of communication of this order.
