Matter is heard in presence of the learned advocates representing the petitioner, State respondents and respondent nos.4 to 6.

A communication dated 21st January, 2026 of the District Judge, Purulia is placed before this Court and same is taken on record.

Learned advocates representing the parties submit that petitioner resumed duty on 2nd January, 2026 under Additional Chief Judicial Magistrate, Raghunathpur, Sub-Divisional Court in terms of the leave granted by this Court vide order dated 22nd December, 2025.

Learned advocate representing the petitioner has submitted that 156 days' leave from 30th July, 2025 to 1st January, 2026 needs to be regularized on

adjusting leave as available as per leave statement of the petitioner.

Prayer is also made for transfer of the petitioner from judgeship of Purulia to judgeship of Bankura and grievance has been raised regarding deduction of professional tax as according to the petitioner, he is entitled to statutory exemption.

Mr. Amal Kumar Sen, learned Additional Advocate General appears on behalf of the State respondents and submits that as petitioner had resumed duty on 2nd January, 2026, other issues may be decided by the concerned authorities, in accordance with law. 7.

Submissions are also made by the learned advocate representing the respondent nos.4 to 6.

As petitioner had resumed duty on 2nd January, 2026, Court directs District Judge, Purulia being respondent no.4 to decide on the issue of regularization of period of absence of the petitioner for a period of 156 days from 30th July, 2025 to 1st January, 2026, if possible, by adjusting leave which was available to the petitioner at the material point of time as per petitioner's leave statement and an appropriate order shall be passed by eight (8) weeks from the date of communication of this order after granting opportunity of hearing to the petitioner and

the Additional Chief Judicial Magistrate, Raghunathpur, Purulia.

Decision to be taken by the respondent no.4 shall be communicated to the petitioner by seven (7) days thereafter.

Other issues, which are raised by the petitioner, are kept open and liberty is granted to the petitioner to raise those issues before the appropriate authority after respondent no.4 takes decision on regularizing period of absence of the petitioner from 30th July, 2025 to 1st January, 2026.

With the aforesaid directions, writ petition stands disposed of.

Let a copy of the communication dated 21st January, 2026 be made over to the learned advocate representing the petitioner.

13.

Urgent photostat certified copy of the order, if applied for, be given to the parties upon usual undertakings.
