1. None appears on behalf of the appellant on various dates (i.e. 04.07.2024, 11.07.2024, 19.07.2024 and 26.07.2024). Thus, the Court had deemed it appropriate to dismiss the matter in default on 26.07.2024 when the matter was taken up. However, on the said date i.e. 26.07.2024, there was a Resolution of Bar and therefore, before signing the order, we considered that it is appropriate not to record an order of dismissal in default on that date. We, therefore, suo moto recalled the order.

2. The matter has, thus, been listed under the heading "To Be Mentioned" today, when the situation has not improved; and even today there is no representation on behalf of the appellant.

3. It appears that the appellant has lost interest in the present appeal. Accordingly, the appeal and the application are dismissed in default. (Madhuresh Prasad, J.) (Supratim Bhattacharya, J.)
