Ct. No. 29.

C.R.R. 4212 of 2011 with IA No. CRAN 1 of 2012 (Old No. CRAN 1230 of 2012) Jummo Bibi Vs.

The State of West Bengal & Anr.

Mr. Madhusudan Sur, Mr. Aniket Mitra ..... For the State.

None appears on behalf of the petitioner.

Learned Advocate on behalf of the State appears. Proper authority is requested to regularize the appointment of Mr. Madhusudan Sur and Mr. Aniket Mitra, learned Advocates. Learned Advocate on behalf of the State submits that this revisional application involving an order under challenge in this revision passed by learned Sessions Judge, Malda whereby learned Judge affirmed the order passed under Section 97 Cr.P.C by learned Executive Magistrate on 08.11.2011, whereby learned Magistrate issued search warrant for production of three children.

On careful perusal of the order impugned, I find that the order was passed with sufficient reasons and learned Judge also appreciated the pragmatic rational view which was substantially

beneficial to welfare of the child. That was the reason learned Judge did not interfere with the order passed by the learned Executive Magistrate.

After careful perusal of the order impugned, I do not find any irregularity or illegality in the order itself. Thus being the position the instant revisional application stands disposed of. Let a copy of this order be communicated to learned Sessions Judge, Malda for information.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
