Begg ... for the State Learned counsel for the petitioner submits that this is a second application for anticipatory bail. The first one was rejected by a Division Bench of this Court on 12.10.2022 in CRM(A) 4875 of 2022. Now, there is a change in circumstance inasmuch as a charge-sheet has been submitted.
Learned counsel for the State submits that a chargesheet has been submitted under the same provisions as were contained in the FIR. Therefore, there is no material change in circumstance.
Submission of charge-sheet is a natural consequence in criminal law after filing of the FIR.
It appears that a charge-sheet has been submitted in this case over the same provisions that were contained in the FIR.
Therefore, there is no material or substantial change in circumstance so as to entertain the second application for anticipatory bail.
Accordingly, the application for anticipatory bail is rejected.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
