State Bank Of India v. Subhendu Das @ Nemai Das & ORS
04.01.2024 S.L.-5(KB) Ct. No.655 C.O. 3819 of 2015 with IA No. CAN 1 of 2016 (Old No. CAN 8548 of 2016) with IA No. CAN 2 of 2016 (Old No. CAN 8593 of 2016) State Bank of India -Versus- Sri Subhendu Das @ Nemai Das & Ors.
In Re: IA No. CAN 1 of 2016 (Old No. CAN 8548 of 2016) with IA No. CAN 2 of 2016 (Old No. CAN 8593 of 2016) Petitioner is not represented.
There is no representation on behalf of the opposite parties.
The instant application is preferred by the petitioner with a prayer for restoration of the revisional application which was dismissed for default on 6th May, 2016 by passing an order of this Court.
Against the said order of dismissal applications are filed on the behest of the petitioner with prayer for restoration of the civil revisional application to its original file and number after condoning the delay.
It appears that the present petitioner is not vigilant in conducting the case and there is reasonable ground to believe that it has lost interest to proceed with the present application.
Accordingly, the applications being IA No. CAN 1 of 2016 (Old No. CAN 8548 of 2016) and IA No. CAN 2 of
2016 (Old No. CAN 8593 of 2016) filed in connection with C.O. 3819 of 2015 are hereby dismissed for default. Interim order, if any, stands vacated.
There will be no order as to costs.
