Learned Advocate on behalf of the State submits that this revisional application involves quashing of the proceedings in connection with G.R. Case No. 6114 of 2011 under Section 384 IPC in connection with Shibpur P.S. Case No. 866/11 dated 6th November, 2011. It is submitted that the petitioners are not taking any steps in compliance with the order dated 24.02.2012 passed by this Court though the Investigating Authority was directed not to submit charge-sheet without the leave of this Court.
On careful perusal of the record, I find that on 24.02.2012 the petitioners were directed to file affidavit-of-service after serving notice along with the application upon the opposite parties. But no such affidavit-of-service has ever been filed before this Court.
Considering all facts and circumstances, I do not find any reason to continue with this revisional application which is pending more than 10 years and the petitioners are not appearing.
Thus the revisional application stands dismissed. Let a copy of this order be communicated to learned Chief Judicial Magistrate, Howrah for information.
Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
