The petitioners are a auction purchaser of a mortgage property, conducted by the Asset Reconstruction Company, the respondent No.1 herein.

The parties are ad idem and as it appears from the records, this writ petition is against the private bodies and not a single party arrayed as respondent herein, is amenable under Articles 12 of the Constitution of India, to the writ jurisdiction of this Hon'ble Court.

Hence, the writ petition fails and is, accordingly, dismissed.

There shall be no order as to costs.

6. Since no affidavit has been called for, the allegations contained in the petition are deemed to have been denied. 7.
