Learned Advocate on behalf of the State appears. Proper authority is requested to regularize the appointment of Mr. N.P. Agarwala and Mr. Nirupam Dhali learned Advocates. Learned Advocate on behalf of the State submits that the petitioners are not taking steps since 2012 when this Court passed an order directing the petitioners to serve notice along with a copy of this application upon the opposite party and to file affidavit-of-service and by order dated 25.01.2012 this Court also passed an order staying the Kalimpong Police Station Case No. 78 of 2008 dated 24.06.2008 corresponding to G.R. Case No. 97 of 2008 under Section 498A IPC, for a period of 12 weeks. After careful perusal of the record, I do not find any such application ever filed by the petitioners for extending the period of stay thereafter.
In the aforesaid facts and circumstances, I do not find any reason to continue with this revisional application. Thus the revisional application stands disposed of accordingly.
Let a copy of this order be communicated to learned Judicial Magistrate, Kalimpong for information. Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
