Mukherjee Mr. Shouvik Naskar ...for the petitioner Mr. Shvroprakash Lahari Ms. Suman Singh ...for the State In terms of the previous order a report in the form of affidavit affirmed on 17th March, 2025 on behalf of District Inspector of Schools (SE), North 24 Parganas, Barrackpore being respondent no.4 is filed today and the same is taken on record.
On perusal of the report it appears that the husband the petitioner died on 1st February, 2025. Therefore, for settling and releasing pension of the petitioner authority of Dum Dum Baidyanath Institution (H.S), Kolkata being respondent no. 5 is required to make necessary modification on portal disclosing present marital
status of the petitioner for releasing retiral dues in her favour.
Accordingly, Head Master, Dum Dum Baidyanath Institution(H.S), Kolkata being respondent no. 5 is directed to make necessary modification on the portal disclosing present marital status of the petitioner by seven days from the date of communication of this order. After such modification is made on the portal respondent no. 4 shall settle the pension case of the petitioner by fortnight thereafter and forward the same to the Director of Pension, Provident Fund and Group Insurance by seven days thereafter. On receipt of pension papers, Director of Pension, Provident Fund and Group Insurance is directed to issue pension payment order by fortnight thereafter on compliance of necessary formalities. Retiral dues including pension shall be released in favour of the petitioner at an early date but not later than eight weeks from the date of communication of this order.
After release of retiral dues, petitioner shall be at liberty to make representation to the concerned state respondents for payment of interest due to delayed payment retiral dues.
If such representation is made, same shall be decided in accordance with law.
Leave is granted to the learned Advocate for the petitioner to amend the cause title in course of this day and add Director of Pension, Provident Fund and Group Insurance, West Bengal as additional respondent.
However, service notice upon additional respondent stands dispensed with since state respondents are represented by learned Advocate.
Accordingly, W.P.A No. 25509 of 2023 stands disposed of.
