1. Heard learned lawyers for both parties.

2. Petitioner submits she is in custody for about 126 days. He submits there was no direct evidence connecting him with murder.

3. Learned counsel appearing for the State submits on his leading statement weapon of offence was recovered.

4. We have considered the materials on record. No one saw the petitioner committing the crime. No ballistic report showing the seized weapons were used to commit the murder is place on record.

5. In view of the aforesaid circumstances, we are of the opinion further detention is not necessary and he may enlarge on bail.

6. Accordingly, we direct the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Chinsurah, Hooghly subject to condition petitioner shall meet the officer-in-charge of Chinsurah Police Station once in a week and also petitioner shall appear before the trial court on each and every date of hearing until further orders and shall not intimidate witnesses and/or tamper with evidence in any manner whatsoever.

7. In the event petitioner fails to appear before the Trial Court without any justifiable cause, the Trial Court shall be at liberty to cancel his bail without any further reference to this Court.
