Munmun Kundu @ Munmun Munshi Mr. Anit Dey ...For the Petitioner This is an application wherein the petitioner has prayed for expeditious disposal of the Matrimonial Suit No. 1192 of 2020 presently pending before the learned Additional District Judge, Fast Track 3rd Court, Barrackpore, North 24 Parganas.

It is submitted on behalf of the petitioner that the issue was framed long back on 14th June, 2022 and thereafter examination of plaintiff's witness No. 1 was started on 1.9.2022 and the said examination of PW 1 has not been completed till today since that date. Accordingly he prayed for a direction upon the Court below to expedite the trial and to conclude the same within a reasonable period. It appears that the prayer made on behalf of the petitioner is innocuous and if any order is passed in terms of the said prayer, other party will have no cause to prejudice and as such service of notice and copy of the application upon the opposite party is dispensed with.

Having considered the fact that the trial of the said suit has been stalled for a considerable period of time and that the prayer made on behalf of the petitioner is justified,

C.O. 3848 of 2024 is hereby disposed of with a direction upon the Court below to make every endeavour to expedite the trial of the said suit and to conclude the entire proceeding of the suit, preferably within a period of six months from the date of communication of this order without granting any unnecessary adjournment to either of the parties and also taking aid from Order XVII of the Code of Civil Procedure. Urgent Photostat certified copy of this order, if applied for, be given to the parties, on compliance of all requisite formalities.
