1. Affidavit of service filed in Court today is taken on record.

2. The petitioner's prayer for grant of increment on account of obtaining Ph.D Degree was forwarded by the School to the District Inspector of Schools, Secondary Education, Uttar Dinajpur in November, 2024. The same is pending consideration till date.

3. Learned advocate for the petitioner submits that the issue of grant of increment is covered by the decision of the Larger Bench of this Court in the matter of Utpal Kanti Karan Vs. The State of West Bengal & Ors. reported in 2024 SCC OnLine Cal 1274, Chowdhury Moniruzzaman Vs. State of West Bengal reported in 2012(5) CHN (CAL) 598 and Uday Sankar Chakraborty Vs. State of West Bengal reported in 2012 SCC OnLine Cal 9392.

4. Without entering into the merits of the claim of the petitioner, as it appears that the prayer of the petitioner for grant of increment is

pending consideration before the District Inspector of Schools, accordingly, the instant writ petition stands disposed of by directing the District Inspector of Schools, Secondary Education, Uttar Dinajpur to consider and dispose of the petitioner's prayer for grant of increment in accordance with law and in the light of the judgments mentioned hereinabove.

5. A decision shall be taken in the matter at the earliest but positively within a period of twelve weeks from the date of communication of this order.

6. The petitioner may be provided an opportunity of hearing to place all relevant documents in support of his prayer.

7. If the prayer of the petitioner is allowed, then necessary consequential steps for disbursement of increment shall be taken without any further delay.

8. The writ petition stands disposed of.

9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Amrita Sinha, J.)
