The order of demolition passed by the Board of Councilors, North Dum Dum Municipality on 27th July, 2023 is yet to be implemented. The petitioner seeks implementation of the same.

It appears that time to implement the order of demolition has expired long back. None of the parties has taken steps for demolition till date. In view of the above, the North Dum Dum Municipality is directed to take steps for demolition of the unauthorised construction for the purpose of implementation of the order dated 27th July, 2023.

The order shall be implemented at the earliest but positively by 29th February, 2024. The Inspector-in-Charge, Narayanpur Police Station is directed to provide adequate police protection and render all necessary help and assistance to the men and agents of the North Dum Dum Municipality at the time of implementing the order of demolition.

The report filed by the Officer-in-Charge, Narayanpur Police Station signed on 23rd November, 2023 be retained with the records.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
