Pursuant to the order dated 26th July, 2024 a report in the form of affidavit has been filed by the learned advocate representing the State respondents which has been affirmed by the District Inspector of Schools (SE), North 24 Parganas on 13th August, 2024. The report is taken on record.

On perusal of the report, it appears that the concerned District Inspector of Schools (SE) vide memo dated 28th September, 2022 requested heads of four institutions which are situated within close proximity to the school where the petitioner is presently serving for giving particulars of willing teacher who can be deputed temporarily in the

school of the petitioner in the resultant vacancy on transfer of the petitioner. It is submitted on behalf of the concerned District Inspector of Schools (SE) that no willing teacher was found.

Having taken note of the averments made in the report as well as submission made on behalf of the State respondents, it appears that the concerned District Inspector of Schools (SE) has taken steps to find out willing teacher in order to make local arrangement in the school of the petitioner in terms of the notification dated 3rd January, 2022 to facilitate petitioner's transfer but due to non-availability of willing teacher local arrangement could not be made in petitioner's school.

In view of steps taken by the concerned District Inspector of Schools (SE) no further order need be passed.

Accordingly, the writ petition stands disposed of.

However, this order shall not preclude the petitioner to make application for transfer in accordance with law in future, if situation so arises.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
